Have just bought s3 64 plate I'm confused on which oil to use 5w30 or 5w40 

Welcome Arron,

Your  handbook will be your best reference. It might differentiate between 5/30 and 5/40 being recommended, depending on the average temperature in the country it’s operating in. 
My guess for your model in our country would be 5w/30, but please check. 

 
In case it helps, I’ve always used VAG’s own brand - Quantum - choosing their Longlife 3, available on EBay from reputable sellers. Filters of choice have been Mann.

I will be doing about 12000 a year on average

I would recommend annual oil and filter changes using the mentioned Longlife oil. 
Renew air filter and pollen filters every two years.

What sort of service history does it have so far?

Not had a chance to look at service book yet thank you for advice will have a look tomorrow

I have found the service history book but it is a digital history which means I have to contact audi and i have to prove i am owner and still waiting on log book to come have some paper work which I will go through on the weekend soon as I get chance

Had an independent service not long before I bought it and 5w30 oil was used has had new rear wheel bearings new disk and pads on front next service due in 9850 miles nothing about pollen and air filter so I will buy them and change them myself i need to get gearbox oil and filter done last time was 4yrs ago 

Apologies, now noticed it’s 12k. 
If it were mine, I would be treating it to an annual oil and filter change going forward, and air and pollen filters every 2 years.
